Five pharmaceutical companies have announced they have filed a complaint in a Canadian court challenging the constitutionality of new regulations in the country. The rulings were part of an effort to lower patented drug prices.
The complaint was submitted to Quebec’s Superior Court by the Canadian divisions of Merck & Co, Johnson & Johnson’s Janssen, Bayer AG, Boehringer Ingelheim and Servier Inc.
The move goes against Canadian Prime Minister Justin Trudeau’s promise to make pharmaceuticals affordable.
The new rules would save patients, employers, insurers and government drug plans money, at the expense of drug company profits in Canada. The regulations give new powers to the Patented Medicine Prices Review Board (PMPRB), which sets maximum drug prices.
The five firms separately stated that in Canada, the provinces have had the authority to regulate the prices of medicines, not the federal government.
The regulations expand the information the PMPRB can consider when setting drug price caps, giving it the ability to consider cost-effectiveness for the first time.
The new rules “will slow and limit Canadians’ access to new breakthrough medicines,” Merck Canada said in a release.

These Terms of Use are also binding for all portals related to Makromedicine.com and for all Makromedicine.com 's distribution partners (such as any portal mentioned at https://mm.lunacenter.us). Therefore in the following Terms of Use, the expression "Makromedicine" includes the Makromedicine.com Database as well as all related portals.
3. Publishing of company profiles
Adding and updating company profiles to Makromedicine.com is completely free of charge. Makromed LLC reserves the right to exclude or otherwise edit any information submitted to its databases. All profiles will be reviewed prior to activation.
4. Extent of Available Information
The number of profiles and additional information available on our website may vary from day to day. We do our best to increase the extent of the available information and its accuracy. Each profile can be updated by the organization itself. Makromed LLC then checks the updated data before it is put online. However, we do not guarantee a minimum number of available company profiles, nor the completeness or accuracy of any profile published in the database. Makromed LLC cannot be held liable for any information available or missing from the database.
5. Quality of available information
Makromed LLC assumes no liability for any damage or loss arising from access to or use of the Makromedicine.com website, the database, and the information contained therein.
The Makromedicine.com Database and all the data included in the database are free of any infringements of any third party’s rights and/or breaches of Makromedicine.com obligation under other agreements.
6. Use of information
The subscriber agrees that any downloaded content will be used for internal purposes only. Particularly, data harvesting will not be allowed, nor the unreasonable use of contact details in sending out emails. Furthermore, no data can be made available to third parties. No part of this website may be reproduced or transmitted in any form or by any means, electronically, mechanically, by photocopying, by recording, or otherwise, without prior permission from Makromed LLC. All data must be deleted if your subscription to this data ends.
7. Extent of use
Makromedicine.com subscriptions are not restricted in terms of the amount of data, but are intended for reasonable usage. The "unlimited" access a subscriber gets to the database does not constitute the right to systematically download all available information in the database. Makromed LLC has the right to block or cancel an account if Makromed LLC deems that a subscriber has exceeded the limit of normal usage (especially if it can be inferred that a subscriber is collecting e-mail addresses). Any use of automated data collecting software is strictly prohibited.
8. Subscriptions & Pricing
Unless otherwise stated in the proposal, the prices for subscriptions are valid for one (1) license per person for the corresponding time period (see also "Automatic Renewal" below). All terms described in this document also apply to site licenses (multiple users). Special rates are available for small and mid-size companies. We keep the right to vary or increase the prices of the subscriptions. Price increases for auto-recurring payments will be announced by e-mail at least one month prior to the renewal of the subscription. If a subscriber does not agree to the new pricing, the subscription can be canceled according to the terms described under "Cancellation of Subscription".
9. Automatic Renewal
Unless you cancel your database subscription, subscriptions will be automatically renewed for the duration that you signed up for and the payment method on record will be automatically charged accordingly. The automatic renewal will be processed 1 to 2 days before the subscription for the current period expires. The receipt for this recurring payment can be downloaded from the "My account - Subscriptions" area in your profile on Makromedicine.com and with the link in the confirmation mail that is being sent to you. Please make sure you have a current e-mail address registered in your profile.
10. Cancellation of Subscription
A subscription can be canceled up to two days before the current subscription period ends. You can cancel your subscription either in the area "My account - Subscriptions" or by sending us an e-mail (see "Contact information" below). If you canceled later, the subscription fee for one more period will be charged to your credit card.
If you cancel a recurring subscription, the subscription remains active until the end of the period for which the last payment has been made.
If you cancel a subscription by e-mail, you will receive an e-mail notification once the subscription has been canceled. If you do not receive such a notification within 48 hours after cancellation, it must be assumed that we did not receive the e-mail. In this case please contact us again.
11. Refund of payments
Makromed LLC does not refund any payments after the cancellation of the subscription. If a subscription is canceled, no further payments will be charged in the future.
12. Expired Subscriptions
If a subscription expires, the account is still available to the user for at least one year after the date of expiration but the extent of information and features will be limited.
13. Use of subscriber's company for reference purposes
Unless otherwise stated in the proposal, Makromed LLC has the right to use the company name and logo of users as a reference on its websites, in email marketing campaigns, on printed materials, or on social media. If a client does not agree to this, the client must inform Makromed LLC in writing. Makromed LLC will then remove the logo and company name from all its website(s) within 14 days and will not use them in any future campaigns and printed material.
14. Limitation of Liability
In no event shall Makromed LLC be liable for damages resulting from loss of data or use of the Makromedicine.com Database, or for any incidental, indirect, punitive, or consequential damages in connection with this agreement or in connection with any products or services provided. We shall exert our best effort to provide you with the highest availability of Database services. We are, however, dependent on external parties and cannot provide any guarantee as to availability or accuracy. We reserve the right to change external parties and information providers at any time.
15. Copyright
All content on Makromedicine.com and its related portals, including text, graphics, logos, button icons, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of Makromed LLC or its content suppliers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of Makromed LLC and protected by international copyright laws. All software used on this site is the property of Makromed LLC or its software suppliers and is protected by international copyright laws.
16. License and Site Access
